EULA - End User License Agreement

Permission is granted to distribute this installer file (.exe) in its unmodified and unregistered form. Other than the preceding statement regarding distribution, the rest of this notice applies to the Song Sergeant software in both its trial (unregistered) and paid-for (registered) forms. In no event shall the software's author or LairWare Software be liable for any damages (including, without limitation, damage for loss of profit, business interruption, loss of information, or other pecuniary loss) arising out of the use or inability to use this product.

All other warranties either express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose, are hereby disclaimed. The exclusion of implied warranties is not permitted by some jurisdictions. The above exclusion may not apply to you. In any event, LairWare Software's liability to you for actual damages from any cause whatsoever, and regardless of the form of the action will be limited to the price you paid LairWare Software for this product.

Your acceptance of this license also represents your agreement that you will not share registration codes for this product, provided to you by Kagi for LairWare, with any other person or organization, and you will not rent, lease, or sublicense this product. You likewise agree that you will make no effort to learn the source code or reverse engineer the product. LairWare Software retains and holds exclusive discretion for determining if and when this license may be returned to LairWare Software and the license fee refunded.

If any provision of this Agreement is invalid or unenforceable under applicable law, it shall not affect the validity or enforceability of the remainder of the terms of this Agreement, and without further action by the parties hereto, such provision shall be reformed to the minimum extent necessary to make such provision valid and enforceable.

This Agreement is governed by the laws of the State of New Mexico and the intellectual property laws of the United States of America. No party to this Agreement will bring a legal action under this Agreement more than one year after the cause of action arose. Each party waives its rights to a jury trial in any resulting litigation.

A Song Sergeant license is a single user license, that is, a license which permits one user to use Song Sergeant on one computer at any given time.
